General Terms and Conditions (GTC)
1. Scope
The following General Terms and Conditions in their version valid at the time of the order shall apply exclusively to the business relationship between Gushjewelry (hereinafter "Seller") and the customer (hereinafter "Customer").
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with Gushjewelry, owner Shahin Salahov, Hattinger Straße 55, 45549 Sprockhövel, Germany (E-Mail: gushjewelry@mail.ru). The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By submitting the order, the Customer makes a binding offer to conclude a purchase contract. The Seller confirms receipt of the order immediately by e-mail; this confirmation does not yet constitute acceptance of the contract. A purchase contract is only concluded through express acceptance or the shipment of the goods.
3. Prices and Shipping Costs
All prices stated are final prices. In accordance with Section 19 of the German Value Added Tax Act (UStG) (small business regulation), no VAT is charged or shown.
In addition to the stated prices, shipping costs may apply, which are clearly displayed to the Customer in the checkout before the order is completed. For order values of €100 or more, shipping within the delivery area is free of charge.
4. Delivery
Delivery takes place within Germany and to other European countries. Delivery time is generally 2–3 working days from the shipment of the order, unless otherwise stated in the ordering process. Shipping is handled by DHL.
5. Payment
Payment is made via the payment methods offered during the ordering process.
6. Retention of Title
The delivered goods remain the property of the Seller until full payment has been made.
7. Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal. Details are regulated in the Cancellation Policy.
8. Warranty
The statutory right of liability for defects applies. If a defect is present, the Customer is entitled to the statutory warranty rights.
9. Liability
The Seller is liable without limitation in cases of intent and gross negligence as well as in accordance with the Product Liability Act. For slight negligence, the Seller is only liable for the breach of essential contractual obligations, limited to foreseeable, contract-typical damages.
10. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
